International SOS - Australian Workplace Health & Safety Laws
International SOS – Australasia has released an updated briefing paper on Australian work health and safety (WHS) laws. Regional Managing Director – Australasia, Michael Gardner, said the briefing paper was commissioned to assist organisations to understand the application of the laws in terms of their workers living or travelling overseas for work, and to assist international businesses with workers travelling or based in Australia.
“The duties owed to workers under the WHS laws are criminal in nature. This means businesses and individuals that fail to discharge the duties imposed on them are exposed to criminal prosecution and, if found guilty, subject to conviction for a criminal offence.
“These papers highlight the importance of duty of care and travel risk management. With new roles and responsibilities for employers and more serious penalties for breaches of the Act, it is crucial organisations are fully aware of the changes and make any necessary amendments to their policies and procedures,” Mr Gardner said.
